Jurors find it hard to tell right from wrong, says study

The legal standard for dishonesty needs to be reviewed because jurors’ widely different views may be affecting the outcome of trials, criminologists say.

Research has revealed huge variations in ordinary people’s ideas of what is dishonest behaviour, which may affect a defendant’s chances of being convicted or acquitted by a jury.

The findings, from a study by Emily Finch and Stefan Fafinski, of Brunel University, question whether the present legal definition of dishonesty is appropriate. Jurors are asked to decide whether a defendant’s actions were “honest according to the standards of reasonable and honest people”. The research suggests that no such universal standard for honesty exists.

Women, the study found, are more likely than men to see ethically dubious actions as dishonest, but men are more likely to vote to convict a defendant accused of these actions. For example, 92 per cent of women thought that it was dishonest to make an insurance claim for pre-existing damage to a car, compared with 85 per cent of men. Only 47 per cent of women, however, would be prepared to convict somebody of fraud on this basis, compared with 55 per cent of men.

Age is another strong influence on perceptions of dishonesty, with older people taking a tougher line in all but a few cases. People are also less likely to consider an action dishonest if they have done it themselves.

The results, from an online test of more than 15,000 volunteers, suggest that attitudes to honesty are so variable that the legal standard needs to be revised, Dr Finch and Dr Fafinski told the British Science Festival at the University of Surrey in Guildford.

Under the present system, two defendants accused of the same crime may stand different chances of being convicted according to the sex and age profile of the jury, and according to whether any jurors have committed similar acts of dishonesty themselves.

“The law is based upon an assumption that the majority of people hold the same views about what conduct is dishonest,” the researchers said. “Our research challenges that assumption, as we found that there is a great deal of disagreement among people, even upon very basic situations.”

“La legge si basa sull’assunto che la maggioranza della gente abbia la stessa opinione su quale sia una condotta disonesta” dicono i ricercatori. “La nostra ricerca sfida quell’assunto, dato che abbiamo trovato che c’è parecchio disaccordo tra la gente, anche in situazioni molto elementari”

Gianfranco Zola has condemned the disgraceful scenes which marred West Ham’s Carling Cup clash with Millwall at Upton Park.

Pitch invasions and ugly confrontations between rival supporters scarred the Hammers’ 2-1 victory in the second round contest.

One man was stabbed in the chest near the stadium as chaos erupted, while police were forced to make a number of arrests as the disorder escalated.

Neil Harris had given Millwall the lead at Upton Park before a brace from Junior Stanislas, including an extra-time penalty, sent the home side through.

The night was completely overshadowed, though, by the actions of certain supporters and Hammers boss Zola admits the trouble is the worst he has seen in his long and distinguished career in the game.

“I’ve been involved in difficult games and things happened. Here, I’ve played seven years and I’ve never seen it like this,” said the Italian coach.

“It’s certainly not good for football. I was completely shocked. Totally.

“What can I say? I’m a sport man. I love the game. I love to go on the pitch and try and make it exciting for the supporters and enjoyable for everybody to watch. This was beyond my powers.”

Millwall boss Kenny Jackett added: “I didn’t fear for my own safety.”

He added: “There were no Millwall fans on the pitch. They stayed where they were supposed to.

“There were a lot of people on the pitch. The lads gathered together and came to the sides, as they should have.

“I wasn’t aware of the stabbing outside the ground. I’m very sad to hear that. We’ve got a passionate game in this country, but when it oversteps the mark then things have to be done.”

West Ham have also released a statement vowing to punish those responsible for the mayhem on Tuesday.

“West Ham will fully investigate the deplorable scenes that took place during the Carling Cup tie with Millwall on Tuesday evening,” the statement read.

“The club will not tolerate the unacceptable behaviour witnessed inside the Boleyn Ground and will take the strongest possible action against anyone found responsible, including life bans.

“As was the case before, during and after the match, we are co-operating fully with the relevant agencies, including the police.”

Janis told Closer: “The family will just say, ‘Enough is enough’. We’d never turn our backs on Amy, but there’d have to come a point where we step back.

“I’m not sure how much more I could go through. Amy knows what we think of Blake so I suppose she’s hiding it.”

She added: “Amy’s done so well getting healthy again. We all hope it’s not true they’re back in touch, but Amy is like a child.

“She says, ‘I love Blake, I love him’, and it’s hard to talk her out of it. She knows he’s bad for her. Who knows what will happen?”

Regarding speculation that Amy wanted to become a mother, Janis said: “Amy says she wants a baby but it’s just talk. Amy doesn’t weigh enough to get pregnant.”

Michael Jackson’s secret emails

Michael Jackson had two secret email accounts which investigators believe may have been used to buy prescription drugs.

Detectives have only recently discovered the accounts and will now go through his messages to see if he was in contact with doctors who could have supplied him.

A source close to the investigation told the Mirror: “They could hold vital evidence with regard to Michael’s death and the drugs he was using regularly.

“Not only did he get prescription drugs through a network of doctors, it’s believed he may also have got them from illegal websites or drug cartels. The LAPD has to get a search warrant first and this takes a few days.”

Police are also examining a private mobile phone line used by the singer which was also only discovered recently.

They will investigate whether he used the phone to contact doctors.

Jackson died two months ago at the age of 50 at his rented property in Los Angeles.

Investigators are working on the theory that the singer’s heart stopped hours after he was given a heavy sedative to help him sleep.

Jackson will be buried at Forest Lawn’s Glendale site, around eight miles north of downtown Los Angeles.

Barack Obama is to host a special boys’ beer night at the White House on Thursday in an attempt to defuse simmering racial tensions over the arrest of a prominent black academic by a white police officer

Henry Louis Gates, a Harvard professor, and James Crowley, the Massachusetts police officer who arrested him after he forced his way into his own home, have been invited to join the US president for a beer on Thursday evening.

The trio have all become embroiled in a row in which Prof Gates alleged he had been a victim of racial discrimination to the anger of police who said the academic had lost his temper and was arrested for disorderly conduct.

Mr Obama, a friend of Prof Gates, became involved after he told a press conference that the police in Cambridge, Massachusetts, had “acted stupidly” in the affair.

As it gradually emerged that he had spoken hastily, the president rang Mr Crowley on Friday to express regret for his choice of words and to invite the pair to the White House for a beer.

The president’s spokesman described the planned meeting as “a chance to talk and a chance to have a dialogue,” adding that the meeting offered a “teachable moment”.

He added: “Weather permitting, they’ll probably sit at the picnic table, behind the Oval Office.”

According to the White House, Mr Crowley has asked for Blue Moon beer, while Mr Obama will be drinking Budweiser. No details have been given about Mr Gates’ beer of choice but, fortunately for the colour theme, he is reported to like Red Stripe, a Jamaican lager.

School closures over flu ‘unlikely’

School closures in the autumn to curb the number of swine flu infections are unlikely at the moment and would have an “extremely disruptive” effect on society, the Chief Medical Officer has said.

Sir Liam Donaldson said the possibility of school closures would be kept under review but in past experience – such as in the West Midlands – this had not been effective at controlling the virus.

He was speaking as ministers were asked to consider closing schools this autumn to help curb the number of swine flu infections.

“I think it would take a lot for us to move in that direction, it would be extremely disruptive to society – when would you open them again, given that flu might be around for several months,” he told GMTV.

“If we look at what we did in the West Midlands for example, where we did very aggressively initially close schools, treat people with Tamiflu who didn’t have symptoms but were contacts of cases, eventually it broke out of the box and spread more widely.

“I think we will obviously keep all of these things under review as we do with any scientific advice, but at the moment I think it is unlikely.”

Amid predictions that the number of cases will soar as the school holidays come to an end, two infection experts have argued that a school closure programme could “break the chains of transmission” and buy time to produce a vaccine.

Professor Neil Ferguson and Dr Simon Cauchemez, from the department of infectious disease epidemiology at Imperial College London, also cited studies showing that closing schools at the height of a flu pandemic could cut the number of cases by up to 45%.

Tra le previsioni di una esplosione dei casi quando finiranno le vacanze scolastiche, due esperti di infezioni hanno argomentato che una chiusura delle scuole potrebbe bloccare la catena di trasmissione e fare guadagnare tempo per produrre un vaccino.

Il professore Neil Ferguson ed il dottor Simon Cauchemez, dal dipartimento di epidemologia dell’Imperial College di Londra, hanno a loro volta citato studi che dimostrano che al picco di una pandemia influenzale chiudere le scuole potrebbe ridurre i casi fino al 45%.

LA police face crowd control challenge at Michael Jackson memorial

Almost 9,000 people were learning of their good luck today as their names were drawn in a lottery for free tickets to the Michael Jackson memorial to be held on Tuesday in Los Angeles.

Organisers of the event said 1.6 million people had registered for tickets, underlining the public demand. It also emphasised the crowd control challenge facing the city’s police on Tuesday, when tens of thousands of ticketless fans are expected to descend on downtown LA.

Each of the 8,750 lottery winners is entitled to two tickets, with 11,000 ticket holders allowed into the memorial ceremony in the Staples Centre, and a further 6,500 into a spill-over venue at the adjacent Nokia theatre.

Among those attending are likely to be many thousands from the UK, with or without tickets. The TMZ website said that flights from London to LA and to large airports in the region, such as San Francisco and Denver, were rapidly filling up.

The New York Post meanwhile reported that the remaining members of the Jackson 5 were considering reuniting. The paper quoted an anonymous family member as saying Michael’s four brothers – Tito, Jermaine, Jackie and Marlon – would seek to fill at least five of the 50 Michael Jackson concerts at the O2 Arena in London, using up to 100 hours of video of his rehearsals as the centrepiece.

The idea was said to have come from the patriarch of the family, Joe Jackson, though there has been no confirmation from any of the family, or from AEG, the promoter of the tour.

LA police will try to maintain order in the city by imposing a large sterile zone around the Staples Centre, through which only lottery winners and accredited family, friends and media will be permitted. That still leaves the question of how thousands of frustrated fans will be accommodated in the surrounding streets.

Tra i presenti probabilmente ci saranno migliaia di inglesi, con o senza biglietto. Il sito TMZ ha detto che i voli da Londra a Los ANgeles e verso i grandi aereoporti della regione, come San Francisco e Denver, si stanno rapidamente riempiendo.

Il New York Post nel frattempo ha riportato la notizia che i rimanenti membri dei Jackson 5 stavano considerando di riunirsi.
Il giornale ha citato un anonimo membro della famiglia che ha dichiarato che i quattro fratelli di Michael – Tito, Jermaine, Jackie e Marlon – starebbero cercando di sostituirlo in almeno 5 dei 50 concerti all’arena O2 di Londra, usando fino a 100 ore di video delle prove come fulcro dello show.

L’idea sembrerebbe essere del patriarca della famiglia, Joe Jackson, manon è stata confermata da nessuno, neanche dalla AEG che organizza il tour.

La polizia di Los Angeles cercherà di mantenere l’ordine in città creando una zona franca attorno al Centro Staples in cui solo le persone che hanno vinto la lotteria potranno accedere, assieme alla famiglia, agli amici ed ai media. Questo lascia comunque aperto l’interrogativo su come migliaia di fans frustrati potranno invadere le strade attorno alla zona.
